1. Introduction
These Terms and Conditions govern the sale and purchase of products through the websites operated by Queer Parrot (referred to as “the Company,” “we,” “us,” or “our”). By placing an order, you agree to be bound by these terms.
2. The Contract
Your order constitutes an offer to purchase a product. The contract between you and Queer Parrot is only formed when we send you an email confirming that your item has been dispatched. We reserve the right to decline any order prior to dispatch for reasons including, but not limited to, product unavailability or errors in pricing.
3. Pricing and Payment
All prices are displayed in Pounds Sterling (GBP) and include VAT where applicable. Delivery charges will be clearly indicated at the checkout stage. Payment must be made in full at the time of ordering via our accepted payment methods.
4. Delivery
We aim to process and dispatch orders promptly. As our products are created using print-on-demand processes, please allow for the specific production times indicated on the product pages. While we make every effort to meet estimated delivery dates, these are not guaranteed.
5. Cancellations and Returns
Our returns policy is designed to be fair while reflecting the nature of our products.
5.1 Defective or Faulty Items
In accordance with the Consumer Rights Act 2015, if a product is defective, damaged, or not as described, you are entitled to a repair, replacement, or refund.
- To initiate this process, please email us with clear photographs of the defect.
- If the item is confirmed to be defective, we will refund the full cost of the item and any reasonable return postage costs incurred by you.
5.2 Non-Defective Items (Change of Mind)
For items that are not defective, the following procedure applies:
- Refund Request: Upon receiving your refund request, we will provide a UK postal address for the return of the product.
- Return Costs: You will be responsible for paying for the shipping costs for returning the item.
- Receipt of Goods: We do not guarantee that we will receive your returned item. We strongly recommend sending your return via registered or tracked post to ensure proof of delivery.
- Condition: Items must be returned in their original, unused condition to be eligible for a refund.
Note: Please refer to our dedicated Delivery and Returns page for detailed instructions on how to package and send your items.
5.3 Personalised and Bespoke Goods
Please be advised that under UK law, the right to cancel a contract within 14 days (the “cooling-off period”) does not apply to goods that are made to your unique specifications or are clearly personalised. For such items, returns are only accepted if the product is defective.
6. Limitation of Liability
Queer Parrot shall not be liable for any indirect, incidental, or consequential damages arising from the use of our products or website. Our total liability for any claim shall not exceed the purchase price of the goods in question. Nothing in these terms excludes our liability for death or personal injury caused by our negligence or for fraudulent misrepresentation.
7. Intellectual Property
All content on this website, including product designs, text, and graphics, is the intellectual property of Queer Parrot, or our licensors. You may not reproduce or use any content without our express written permission.
8. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
